Rules governing access to and use of the CDE Flash Card service
These Terms of Use ("Terms") form an agreement between you and [REGISTERED COMPANY NAME], operating as CDE Flash Card ("CDE Flash Card", "we", "us" or "our"). They apply to the CDE Flash Card website, application, accounts, subscriptions, learning materials and related services (together, the "Service").
By creating an account, purchasing a subscription or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Accounts must be created and managed by a parent, legal guardian or other authorised adult who has legal capacity to enter into this agreement. The account holder is responsible for supervising any child who uses the Service through the account.
Children must not create independent accounts, purchase subscriptions or submit personal information directly to us.
CDE Flash Card provides digital educational content, including flash cards, dot-based learning, mathematics, language and general-knowledge materials. The Service supports learning at home and does not replace parents, teachers, schools, professional assessment or individual educational advice.
Content, features, topics and availability may change as the Service develops. We do not promise that every topic will be suitable for every child or that use of the Service will produce a particular academic or developmental outcome.
You must provide accurate, current and complete account information and keep it updated. You are responsible for keeping your login details confidential and for activity carried out through your account, except where responsibility cannot lawfully be assigned to you.
Tell us promptly at [SUPPORT EMAIL ADDRESS] if you believe your account has been accessed without permission. We may request reasonable information to verify account ownership before changing access details.
Subject to these Terms and payment of any applicable fees, we grant you a limited, personal, non-exclusive, non-transferable and revocable right to access and use the Service for private household and educational use.
This licence does not transfer ownership of the Service or its content. Unless we give written permission, you may not reproduce, sell, licence, distribute, publish, publicly display, commercially exploit or create competing materials from substantial parts of the Service.
Some content or features may require a paid subscription. The plan description shown before purchase will state the applicable price, billing period, included access and any material limitations.
If automatic renewal applies, the renewal timing, price and cancellation method must be clearly disclosed before purchase.
Access normally begins after payment is successfully confirmed. A failed, reversed or overdue payment may result in restricted or suspended access after any notice required by law or the relevant payment process.
Prices will be displayed in the stated currency and may include or exclude applicable taxes as shown at checkout. You authorise the selected payment provider to charge the disclosed amount using your chosen payment method.
Payments are processed through [PAYMENT PROVIDER NAME]. We may change prices for future purchases or renewal periods by giving the notice required by law. A price change will not alter a completed fixed-term purchase unless you agree or the law permits it.
You may cancel a subscription using [INSERT CANCELLATION METHOD] or by contacting [SUPPORT EMAIL ADDRESS]. Cancellation normally stops the next renewal and does not automatically refund a period already paid for, unless the plan terms, an applicable platform rule or Malaysian law provides otherwise.
[INSERT THE ACTUAL REFUND RULES, ELIGIBILITY PERIOD, EXCLUSIONS AND PROCESS].
Nothing in these Terms excludes, restricts or modifies a consumer right or remedy that cannot lawfully be excluded under Malaysian law.
• You must use the Service lawfully and in a way that does not harm the Service or other users. You must not:
• Share, sell, rent or transfer account access outside the permitted household or plan
• Copy, scrape, download or systematically extract substantial content except through an expressly provided feature
• Reverse engineer, interfere with or attempt to bypass security or access controls
• Upload malware, harmful code or content that violates another person's rights
• Use automated systems to overload, probe or disrupt the Service
• Misrepresent your identity, payment authority or relationship with another person
• Use the Service or content for unlawful, fraudulent or unauthorised commercial purposes
The adult account holder is responsible for selecting age-appropriate content, supervising a child's use and deciding how the Service fits within the child's wider learning, play and screen-time routine.
Do not allow a child to submit identifying information, contact strangers, make purchases or change account settings. If you believe a child has submitted personal information without appropriate authorisation, contact [PRIVACY EMAIL ADDRESS].
We aim to prepare accurate, age-appropriate and useful educational content, but content may contain occasional errors or may not match a particular curriculum, school, teaching method or child's needs. The Service is provided as a supplementary learning resource.
You should use reasonable judgment and contact an appropriate educator, healthcare professional or other qualified professional if you have concerns about a child's learning, development or wellbeing.
The Service and its text, illustrations, images, audio, videos, characters, designs, databases, software, trademarks and learning sequences are owned by us or used under licence and are protected by applicable intellectual-property laws.
CDE Flash Card and associated branding may not be used in a way that suggests endorsement, partnership or ownership without our written permission.
If you send feedback, ideas or suggestions, you allow us to use them to improve the Service without payment or obligation to implement them. This does not transfer ownership of your personal data or any material that you do not have the right to submit.
Do not submit confidential business information, unlawful material or content belonging to another person without permission.
The Service may depend on or link to third-party payment, hosting, app-store, authentication or other services. Third-party services are governed by their own terms and policies. We are not responsible for a third party's independent acts or content, but this does not limit any responsibility we cannot lawfully exclude.
We may maintain, update or change the Service and may add, remove or replace content or features. We will take reasonable steps to avoid unnecessary disruption and to give appropriate notice of material changes affecting paid access.
Temporary interruptions may occur because of maintenance, security issues, internet or provider failures, or events outside reasonable control. We do not guarantee uninterrupted or error-free availability.
We may restrict, suspend or terminate access where reasonably necessary because of a serious or repeated breach of these Terms, non-payment, fraud, security risk, unlawful use or legal requirement. Where appropriate and lawful, we will give notice and a reasonable opportunity to resolve the issue.
You may stop using the Service and request account closure at any time. Sections that by their nature should continue, including intellectual property, payment obligations, disclaimers, liability and dispute provisions, will survive termination.
To the maximum extent permitted by law, the Service is provided on an as-available basis. We do not give guarantees beyond those expressly stated in these Terms or required by law.
We are not liable for losses caused solely by circumstances outside our reasonable control, a user's unlawful or unauthorised conduct, incompatible devices or third-party services we do not control. We remain responsible to the extent liability cannot lawfully be excluded or limited, including any non-excludable consumer protection.
Where liability may lawfully be limited, our aggregate liability arising from the Service will not exceed the amount you paid directly to us for the affected Service during the 12 months before the event giving rise to the claim. This limitation does not apply where prohibited by law or where a different mandatory remedy applies.
Our Privacy Policy explains how we handle personal data. By using the Service, you acknowledge that you have read the Privacy Policy. The Privacy Policy does not reduce any right provided by applicable data-protection law.
We may update these Terms to reflect changes to the Service, prices, providers, security practices or law. The revised Terms will be posted with a new Last Updated date. If a material change affects an existing paid subscription, we will provide additional notice where appropriate and any choice required by law.
Continued use after revised Terms take effect means you accept them, except where applicable law requires another form of agreement.
These Terms are governed by the laws of Malaysia. The courts of Malaysia will have jurisdiction, subject to any mandatory consumer right to bring a claim in another competent forum.
Before starting formal proceedings, you and CDE Flash Card should first try in good faith to resolve the dispute by contacting the other party and providing reasonable details. This does not prevent either party from seeking urgent relief or using a consumer or regulatory complaint process.
If any provision is held invalid or unenforceable, the remaining provisions will continue to apply. A delay in enforcing a right is not a waiver of that right. You may not transfer your account or rights under these Terms without our written approval. We may transfer these Terms as part of a genuine business reorganisation, sale or transfer, subject to applicable law and continued protection of your rights.
These Terms, the Privacy Policy and any plan-specific terms presented at purchase form the agreement concerning the Service. If plan-specific terms conflict with these Terms, the plan-specific terms govern only for that purchase, unless the law requires otherwise.
